Algemene voorwaarden
1. Operational Control and Responsibility
1.1. Flying Legends maintains full operational control and responsibility over the aircraft and its flights.
1.2. The captain of the aircraft has complete authority over flight decisions, including safety measures, load distribution, and landing locations. The Client agrees to accept all decisions made by the captain.
1.3. Flying Legends is free to appoint any licenced pilot to any oldtimer flight as necessary, without prior notice to the Client.
2. Flight Schedules
2.1. Flight times are approximate and not guaranteed.
2.2. Flying Legends is not liable for delays caused by air traffic control, weather conditions, or any other factors beyond its control.
2.3. In case of Client-caused delays, Flying Legends reserves the right to cancel the flight and claim damages.
2.4. The Client may request flight schedule changes, subject to applicable cancellation fees and additional preparation costs.
2.5. Flight durations are approximate and not guaranteed, although Flying Legends will do the utmost to meet the expected flying time.
3. Authorizations and Permits
3.1. Flying Legends will apply for necessary permits and authorizations for the flights but is not liable for any refusals or delays in obtaining them.
3.2. The Client must provide the requested identification with sufficient notice to allow for permit processing.
4. Documents
4.1. Flying Legends will issue travel documents according to its procedures, which bind the Client and passengers.
4.2. The Client must comply with all relevant laws and regulations, including safety and health regulations, and ensure all necessary documentation is in order.
5. Dangerous Goods and Prohibited Articles
As a rule of thumb, no baggage is allowed during our flights.
6. No Subcontracting by the Client
The Client must use the entire capacity of the aircraft for their own passengers and may not resell or sub-charter any part of the aircraft.
7. Conduct on Board
Flying Legends' captain may take necessary measures, including restraint, to prevent any passenger conduct that endangers the aircraft, others on board, or the ground crew.
8. Aircraft Unserviceability
If the aircraft becomes unserviceable, Flying Legends may cancel the flight and will use its best efforts to source a substitute aircraft. If no substitute can be provided under the existing agreement terms, a separate ad hoc agreement may be offered.
9. Liabilities
9.1. The Client indemnifies Flying Legends against any costs or damages arising from the Client's failure to comply with the agreement or relevant regulations.
9.2. Flying Legends' liability for passenger damage is limited according to applicable regulations and conventions.
9.3. Liability for third-party damage is limited according to international conventions or applicable local laws.
9.4. Flying Legends' liability is limited to the terms specified in these GTCC.
10. Insurance Coverage
Flying Legends will maintain insurance coverage as required by applicable regulations throughout the term of the agreement.
11. Data Protection and Privacy
11.1. Flying Legends will handle personal data in compliance with GDPR and its privacy policy.
11.2. Personal data may be transmitted to public authorities and other relevant parties as required by law.
11.3. Confidential information obtained during flight services will not be disclosed except as necessary for service delivery, legal requirements, or to authorized parties.
12. Applicable Law and Competent Court
2.1. This agreement is governed by Belgian and European Union laws.
12.2. Disputes should be settled by negotiation or mediation. If unresolved, disputes may be brought before the Commercial Court of Antwerp.
13. Prohibited Business Practices and Sanctions
The Client must comply with all laws related to anti-bribery, anti-corruption, anti-money laundering, and economic sanctions. The Client must not engage in any activities that could lead to a breach of these laws.
14. Amendments
Flying Legends reserves the right to amend these GTCC at any time. Continued use of Flying Legends' services implies acceptance of the updated terms.
These GTCC constitute the entire agreement between the Client and Flying Legends and supersede all previous agreements.
